Terms of Service
These terms govern the provision of freight and logistics services by JND Transport and Logistics Pty Ltd (ABN 79 702 805 589), based in Melbourne VIC, Australia. Last updated: 1 July 2025.
1. Acceptance of Terms
By engaging JND Transport and Logistics Pty Ltd (“JND”, “we”, “us”, “our”) to provide freight, transport or logistics services, or by requesting a quote or placing a booking through jndtransportandlogistics.online, you (“the Client”) agree to be bound by these Terms of Service. If you do not agree with these terms, please do not use our services.
2. Who We Are
JND Transport and Logistics Pty Ltd is an Australian proprietary limited company registered under ABN 79 702 805 589, providing freight and logistics services from Melbourne VIC to clients across Victoria and wider Australia.
3. Our Services
We provide road freight, line-haul transport, palletised freight movements, warehousing support and last-mile delivery services. The specific scope of services, collection and delivery points, timeframes and charges for each engagement will be set out in your quote, booking confirmation or written agreement with us. Descriptions of our standard services are available on our Services page.
4. Quotes and Bookings
- All quotes provided by JND are valid for the period stated on the quote, or 14 days where no period is stated.
- Quotes are based on the information you provide, including freight type, dimensions, weight, pickup and delivery locations. If that information is inaccurate or changes, the quoted price may be revised.
- A booking is only confirmed once we have accepted it in writing and, where applicable, received any required deposit.
- Indicative transit times are estimates only and are not guaranteed unless expressly agreed in writing.
5. Payment Terms
- Invoices are payable in Australian dollars (AUD) by the due date stated on the invoice.
- Where credit terms are granted, payment is due within 14 days of invoice date unless otherwise agreed in writing.
- Overdue amounts may attract interest and reasonable recovery costs.
- We may suspend services or withhold deliveries where invoices remain unpaid past their due date, to the extent permitted by law.
- All prices are quoted exclusive of GST unless stated otherwise. GST is payable in addition where applicable.
6. Client Obligations
You agree to:
- Provide accurate and complete information about your freight, including any dangerous, fragile, perishable or high-value goods, before booking.
- Ensure goods are appropriately packaged, labelled and ready for collection at the agreed time and location.
- Ensure safe and lawful access to pickup and delivery sites, including loading docks and driveways.
- Comply with all applicable laws relating to the goods you consign, and warrant that you are legally entitled to ship them.
- Not consign prohibited, illegal or hazardous items unless expressly agreed and documented in advance.
7. Cancellations, Variations and Delays
- Cancellation or variation requests must be made in writing. Fees may apply where a booking is cancelled after a vehicle has been dispatched or where costs have already been incurred.
- Transit times may be affected by factors outside our control, including traffic, weather, road closures, accidents and site access issues. We will keep you informed of significant delays where practicable.
- Where a delivery cannot be completed due to a matter within your control (for example, no access at the delivery address), redelivery fees may apply.
8. Risk, Title and Insurance
Risk in the goods remains with you (or your customer, as applicable) except to the extent caused by our negligence. Title in goods passes in accordance with your underlying sale arrangements and is not affected by carriage. Clients are responsible for arranging their own cargo insurance where they require cover beyond any liability we accept under these terms or applicable law. We recommend confirming insurance arrangements before consigning high-value goods.
9. Liability
- To the fullest extent permitted by law, our aggregate liability arising out of or in connection with any single consignment or engagement is limited to the charges paid by you for that consignment or engagement.
- We are not liable for indirect or consequential loss, including loss of profit, loss of business or loss of contract.
- Nothing in these terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law or other legislation that cannot lawfully be excluded.
10. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For services, you are entitled to a refund or replacement for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services supplied again or paid for if the services fail to be of acceptable quality and the failure does not amount to a major failure. For further information about your consumer rights, visit the Australian Competition and Consumer Commission website at accc.gov.au.
11. Force Majeure
We are not liable for failure or delay in performing our obligations where that failure or delay is caused by events beyond our reasonable control, including natural disasters, floods, fires, pandemics, industrial action, government restrictions, road closures or failures of third-party infrastructure.
12. Privacy
We handle personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). By engaging our services, you consent to us collecting, using and disclosing personal information as described in that policy, including for the purpose of providing freight and logistics services.
